NOTICE OF FAIRNESS AND COMPLIANCE HEARING FOR CONSIDERATION OF AN AMENDED SETTLEMENT AGREEMENT AND HOUSING ELEMENT AND FAIR SHARE PLAN OF THE TOWNSHIP OF VOORHEES, COUNTY OF CAMDEN ("TOWNSHIP")

PLEASE TAKE NOTICE that on Wednesday, May 7, 2025, beginning at 10:00a.m., a Fairness and Compliance Hearing ("Hearing") will be conducted before the Honorable Sheri L. Schweitzer, P.J.Ch. at the Camden County Court House, Hall of Justice, 101 South 5th Street, Courtroom 62, Camden, New Jersey 08103. Upon conclusion of the Hearing, the Court will determine whether the of the Amended Settlement Agreement between the Township and Fair Share Housing Center ("FSHC") an Interested Party and whether the Township's Housing Element and Fair Share Plan ("Affordable Housing Plan") in order to resolve the within Declaratory Judgment action is fair and reasonable to low income and moderate income households and satisfies the Township's obligation to provide a realistic opportunity for the creation of affordable housing pursuant to its constitutional responsibilities under the
Mount Laurel Doctrine
.
Entry of a Final Judgment of Compliance and Repose would declare the Township in compliance with its obligation to have provided and to provide realistic opportunities for the construction of housing affordable to low income and moderate income households as defined in the
Mount Laurel Doctrine
and pursuant to the Fair Housing Act,
N.J.S.A.
52:27D-301 et seq., thereby entitling the Township to a continuing Judgment of Compliance and Repose through July 1, 2025 for protection from any builders remedies and exclusionary zoning lawsuits pursuant to the
Mount Laurel Doctrine
.
The Court will consider whether the Amended Settlement Agreement and Affordable Housing Plan to be adopted by the Township Planning Board and endorsed by the Township Committee subject to the Court's approval, satisfies the Township's obligation to provide a realistic opportunity for the creation of affordable housing. The Amended Settlement Agreement and Affordable Housing Plan addresses the Township's Present Need Obligation (or rehabilitation obligation) of 9 housing units, its Prior Round Obligation of 456 housing units and its Third Round Prospective Need Obligation of 510 housing units, all as determined by the Fair Housing Act,

52:27D-301, et seq., the substantive and application regulations governing affordable housing in the State of New Jersey and the New Jersey Supreme Court's March 10, 2015 decision in the matter of
In re N.J.A.C. 5:96 and N.J.A.C. 5:97

. 1 (2015), and other applicable law. The Amended Settlement Agreement and Affordable Housing Plan sets forth those compliance mechanisms the Township will employ to address its affordable housing obligation.
A copy of the Amended Settlement Agreement and Affordable Housing Plan in this matter are filed with the Court and placed on file for public inspection at the Township of Voorhees Clerk's Office, 2400 Voorhees Town Center, Voorhees, New Jersey 08043. These documents will be available for public inspection and photocopying during normal business hours. Their contents are incorporated herein by reference as if more fully set forth at length herein.
All interested parties shall be provided with an opportunity to appear and be heard at the Hearing.
ALL OBJECTIONS, COMMENTS, OR POSITIONS TAKEN BY INTERESTED PARTIES MUST BE FILED WITH THE COURT BY NO LATER THAN WEDNESDAY, APRIL 30, 2025. SAID OBJECTIONS SHALL BE FILED WITH THE HONORABLE SHERRI L.
